The short version

mySimsbury is a free app for people in Simsbury, Connecticut. It is an independent project and the Town of Simsbury has no involvement in it. It is an early pilot. Use it, enjoy it, and do not rely on it for anything critical.

Rewards points are a promotional loyalty currency. They are not money, they have no cash value, and during the pilot they will be reset to zero before public launch.

Who runs mySimsbury

mySimsbury is built and operated by Michael Zemel, a Simsbury resident. In these terms, “we” and “us” mean him.

The Town of Simsbury does not own, operate, fund, endorse or administer mySimsbury, and has not been asked to. Michael serves on the Town’s Economic Development Commission; mySimsbury is not a project of that commission and nothing in this app should be read as the Town speaking.

The intention is for mySimsbury to be run by a local nonprofit with a community board of directors, so that it belongs to Simsbury rather than to one person. That organization does not exist yet. If and when it takes over, these terms will be updated to say so and the date at the top of this page will change.

This is a pilot

mySimsbury is under active development and is not a finished product. In practical terms that means:

• Every point balance, badge, achievement and leaderboard position currently in the app is demo data, and will be reset to zero before public launch. The “Demo” badge in the header is there to say so on every screen.
• Features may be added, changed or withdrawn without notice.
• The service may be unavailable, and data may be lost.

Who may use it

You must be 18 or older to hold a mySimsbury account. The app is intended for residents of and visitors to Simsbury, Connecticut.

You sign in with a Google account. Keep your access to that account secure — anyone who can sign in as you can spend your points. Do not create more than one account for yourself, and do not share an account.

Simsbury Rewards points

Points are a promotional loyalty currency issued by participating local businesses. They are not money and not a stored-value instrument. Specifically:

• Points have no cash value, cannot be exchanged for cash, and cannot be sold or transferred to another person.
• Points expire after 24 months of account inactivity. Any earning or redeeming resets that clock. There are no dormancy or maintenance fees.
• We may modify, suspend or end the points program, with notice where practical.
• A reward is fulfilled by the participating business, not by us and not by the Town. Questions about a specific reward go to that business.
• Earning points requires a real transaction at a participating business. Fabricating transactions, or issuing points to yourself as a merchant or as an employee of one, is a misuse of the program.
• A business may give its staff an employee code, which lets them issue points and fulfil rewards on that business's behalf and at that business's cost. The business remains responsible for what is issued under its name. Anyone holding such a code can hand it back from the Rewards app at any time.

Seek and other outdoor features

Seek, Trail Maps and similar features involve going outside and moving around the physical world. Your safety is your responsibility.

• Pay attention to your surroundings. Do not use the app while driving, cycling or otherwise operating anything.
• Obey all laws, posted signs, trail closures and property boundaries. A location appearing in the app is not permission to enter it.
• Trail maps are provided for general information. They are not survey-grade, they may be out of date, and they are not suitable for navigation or emergency use. Carry appropriate equipment and judgment.
• Location check-ins must reflect where you actually are. Falsifying your location is a misuse of the app.

Information in the app

Calendar events, meeting documents, property records, town contact details and trail maps are gathered from public sources and from the organizations concerned. We make a reasonable effort to keep them accurate, but we do not guarantee that any of it is correct, complete or current. For anything that matters — a meeting time, a permit requirement, a phone number — confirm it with the Town or the organization directly.

The trail maps are other people’s work, and they stay that way. They come from the Simsbury Land Trust, which has given permission for us to publish them, and from the Connecticut Department of Energy and Environmental Protection, which publishes its state park and forest maps for public use. Each map links back to the page it came from. We claim no ownership of any of them, and reproducing them from here is a question for whoever made them, not for us.

Acceptable use

Do not use mySimsbury to break the law, to defraud the points program or a participating business, to harass anyone, to gain unauthorised access to any part of the system, or to place automated load on it. We may suspend or remove an account that does.

No warranty

mySimsbury is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, secure, error-free, or that any information in it is accurate.

Limitation of liability

To the fullest extent permitted by Connecticut law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of points, data, profits or goodwill, arising out of your use of mySimsbury — whether or not we were advised that such damages were possible.

Nothing in these terms limits any liability that cannot lawfully be limited.

Changes

We may update these terms as the project develops. The date at the top of this page is when they last changed. Continuing to use mySimsbury after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-law rules.
