I. CALL TO ORDER – Chair Braz called the meeting to order at 7:01 P.M.9

II. APPROVAL OF MINUTES21

Planning Director McGregor recommended amending Line 53 to remove “2.” and25
bring the sentences up to number 1.26

MOTION: Vice Chair Leary made a motion, seconded by Commissioner Beal, to28
approve the Minutes of the April 6, 2026, Regular Meeting as amended. The motion29
carried unanimously (6-0-0).30

Application ZC 26-09, of Allan Koerner, Esq., Applicant, G&F Associates Cambridge36
Crossing LLC, Owner, for a site plan amendment to revise elements including the37

phasing, landscaping, the affordable housing plan, and select conditions at the38
Cambridge Crossing (now Copper Hill Estates) development on Cambridge Court,39
accessed via Hoskins Rd., Zone Workforce Housing Overlay Zone (WHOZ), Assessor40
ID: Map H05 Block 403 Lot 021 A&5.41

Planning Director McGregor and Attorney Koerner, Esq., discussed the proposed site43
plan amendment. The Commission asked several follow-up questions concerning the44
issue of rental versus home ownership, sidewalks, reduction in vegetation, and fence45
installation.46

MOTION: Vice Chair Leary made a motion, seconded by Commissioner Beal, that48
the Zoning Commission APPROVES ZC 26-09 a site plan amendment to revise49
elements including the phasing, landscaping, affordable housing plan, and select50
conditions at the Cambridge Crossing (now Copper Hill Estates) development, based51
on a finding that the amendments substantially meet the requirements of the Simsbury52
Zoning Regulations and act to address the many outstanding issues identified prior to53
the introduction of the new development team, subject to the following conditions:54

1. The property shall be developed in substantial conformance with the Phasing Plan56
set dated April 20, 2026, prepared by Fluid Earth, LLC.57
2. The property shall be developed in substantial conformance with the Affordable58
Housing Plan dated April 2026.59
3. The property shall be developed in substantial conformance with the Phase 160
Landscaping Plan (units 2-30) dated April 20, 2026, adding 50 arborvitae plants.61
4. The property shall be developed in substantial conformance with the Architectural62
elevations dated April 23, 2026 (Hartland, Westbury, Brookfield, Willow models).63
Additional model homes may be added to the foregoing models with the approval of64
the Planning and Community Director.65
5. At the time appropriate site improvements are in place to restart the issuance of new66
residential permits, the first four (4) residential permits issued for construction shall be67
for affordable units in order to catch up on the pro-rate requirement. Permits for68
additional market-rate homes may be issued after this however, the four (4) affordable69
units must receive certificates of occupancy before any other units.70
6. The requirement to construct as off-site sidewalk from Cambridge Court to71
Hopmeadow St. as represented in conditions 1-7 and found in the ZC 17-10 Zoning72
Approval is declared null and void.73
7. Fences shall be approved by the HOA and shall have a maximum height of four feet74
when facing or fronting on the Cambridge Court St.75
8. All other conditions established by the Zoning Commission in previous applications76
remain in full force and effect.77

Commissioner Battos opposed the motion. The motion carried (5-1-0).79

Planning Director McGregor reported that there will be a special meeting on May 26th

with the Planning Commission to discuss the zoning update with the consultant.86

V. EXECUTIVE SESSION88

MOTION: Chair Braz made a motion, seconded by Vice Chair Leary to go into90
Executive Session, pursuant to General Statutes Section 1-200(6)(B): Discussion of91
Pending Litigation and/or Claim. The motion carried unanimously (6-0-0).92

The Commission entered into Executive Session at 8:00 P.M.94

MOTION: The Commission exited executive session at 8:13 P.M after a motion by96
Commissioner Beal, seconded by Commissioner Battos. The motion carried97
unanimously (6-0-0).98
